At Nerdworth, operated by Nerdbeak, Inc. ("we," "us," or "our"), your privacy matters to us. This Privacy Policy explains what information we collect, how we use it, and the measures we take to safeguard it. In short, we do not sell your data—ever.
By accessing or using the Nerdworth website, platform, or related services (collectively, the "Platform"), you acknowledge that you have read, understood, and agree to the practices described in this Privacy Policy. If you do not agree, please discontinue use of the Platform.
1. Information We Collect
1.1 Information You Provide
We collect the information you give us directly. This includes data you provide when signing up for an account, creating a profile, listing items, making purchases, or contacting us for support. Examples include:

- Shipping or billing address (when needed to complete transactions)
- Information you share in your profile or listings

1.2 Usage Data
We collect information about how you interact with the Platform, including:

- Device type, browser type, and approximate location (based on IP)
We collect this information to help us improve and personalize your experience on Nerdworth.

1.4 Payment Information and Stripe
When you buy or sell on Nerdworth, payments are processed by third-party payment processors such as Stripe.
- We do not store your full payment card numbers on our servers.
- Stripe or similar providers receive your payment information directly and process it in accordance with their own privacy policies and terms.
- We may receive limited information from these processors (e.g., last 4 digits of card, card type, payment status) for record-keeping and fraud prevention.
1.5 SMS and Text Messaging
If you use our text-to-list feature by sending SMS or MMS messages to our platform phone number, we collect:
- Your phone number
- The content of text messages you send to and receive from us
- Images and media you send via text for the purpose of creating listings
We use this information to provide the text-to-list service, including creating marketplace listings on your behalf, and as described in Section 2 (such as AI processing to catalog items and improve the Platform). Your phone number is linked to your Nerdworth account to identify you. We do not share your phone number or SMS content with third parties for marketing purposes. Message and data rates may apply. You can opt out of SMS messages at any time by texting STOP.
1.6 Third-Party Services and Analytics
We may use third-party services to help us operate and improve the Platform, including:
- Analytics providers (e.g., to understand usage and performance)
- Artificial intelligence and machine learning providers (e.g., to process images, generate product metadata, and power catalog features)
- SMS and messaging providers (e.g., to deliver text messages)
- Email and notification providers
- Cloud hosting and infrastructure providers
These third parties may collect or receive information about your use of the Platform (for example, your IP address or pages visited) as necessary to provide their services to us.
We do not authorize these providers to sell your personal data.
2. How We Use Your Information
We use the information we collect for purposes including, but not limited to:
- Providing and maintaining the Platform: Operate the site, enable logins, process payments, and provide marketplace features.
- Facilitating transactions: Show listings, process orders, send confirmations, and support payouts to sellers.

- AI and automated processing: Use artificial intelligence and machine learning to identify, categorize, and catalog items from submitted images and content; generate product metadata such as titles and descriptions; power search and discovery features; and train and improve our internal models and catalog systems.
- Communicating with you: Send updates about transactions, security alerts, policy changes, and (when permitted) product updates or marketing emails.
- Preventing fraud and maintaining security: Detect, investigate, and prevent fraudulent or abusive activity, enforce our Terms, and ensure a safe environment.
We do not sell or rent your personal information to third parties.
3. Security
We implement reasonable security measures, such as encryption and secure server protocols, to protect your data from unauthorized access, alteration, disclosure, or destruction. However, no method of internet transmission or electronic storage is entirely secure. You should use strong passwords and exercise caution when sharing information online.
Access to personal information on the Platform is restricted to you (the account holder) and to authorized personnel and systems. Accessing, collecting, or attempting to access personal information that is not your own, or circumventing our authentication, access controls, or other safeguards, is strictly prohibited under our Terms of Service and may violate the Computer Fraud and Abuse Act and other applicable laws. We reserve the right to pursue all available legal and equitable remedies against any person who does so. If we become aware of a security breach affecting your personal information, we will notify affected users and applicable authorities as and when required by applicable law.

Depending on your location and applicable law, you may have rights including:
- Accessing the personal information we hold about you
- Requesting correction of inaccurate or incomplete information
- Requesting deletion of your personal information (subject to legal retention requirements)

As mentioned above, Nerdworth uses cookies to enhance your experience. Please note, however, that blocking cookies may affect the functionality and availability of some features on the Platform.

Nerdworth is not directed to children under the age of 13, and we do not knowingly collect personal information from children under 13. We will take steps to remove such information and terminate the child's account.
8. California Privacy Rights (CCPA/CPRA)
If you are a resident of California, you may have additional rights under the California Consumer Privacy Act (CCPA) and related laws.

In the preceding 12 months, we may have collected the following categories of personal information:

- Communications data (e.g., SMS/MMS message content and media sent via text-to-list)

We collect these categories for the business purposes described in Sections 1 and 2.
8.2 No Sale of Personal Information
We do not sell your personal information as "sale" is defined under the CCPA.
8.3 Your CCPA Rights
Subject to certain limitations, California residents may have the right to:
- Request disclosure of the categories and specific pieces of personal information we have collected about you
- Request deletion of your personal information
- Request information about how we have handled your personal information in the past 12 months
